On November 28, 2022, the State Bank of Vietnam (SBV) issued Document No. 9362/NHNN-TT, which was sent to the payment service providers and the intermediary payment service providers, requesting them to enhance the measures to ensure the security and safety, prevent and mitigate the risks of abusing payment services for gambling, organizing gambling, and illegal betting.
With a view to enhancing the measures to ensure the security and safety of payment activities, actively prevent and mitigate the risks of abusing payment services, intermediary payment services for illegal activities, especially during the 2022 FIFA World Cup, the SBV has requested the payment service providers and the intermediary payment service providers to urgently and seriously implement the following activities:
Enhancing the measures to ensure the security and safety, preventing acts of using, abusing payment services, intermediary payment services for gambling, organizing gambling, illegal betting, recharging, paying for electronic games that are not licensed by the state management agencies in line with the guidance of the SBV as stated at Document No. 1080/NHNN-TT dated February 21, 2020, and other guiding documents of the SBV on ensuring the security and safety of payment activities, intermediary payment activities, and on anti-money laundering.
Focusing on the measures to strictly manage the opening and use of payment accounts and e-wallets; Implementing inspection and supervision in order to detect and thoroughly handle with such cases as: impersonation, use of fake documents to open and use payment accounts, e-wallets; buying, selling, renting, leasing, borrowing, or lending payment accounts, e-wallets; buying, selling, renting, or leasing a bank card or bank card information; opening a bank card in the name of another person.
Reviewing all supervisory criteria, the transaction limits, and updating suspicious signs in the provision of payment services, intermediary payment services, etc., ensuring compliance with the subgroup categorization/classifications of payment accounts, e-wallets, customer groups/classification, payment accepting units, to ensure relevance to their scale of operation, the industry and business area in order to enhance the effectiveness of monitoring and detecting suspicious and unusual transactions, and take prompt measures to handle with those cases in accordance with the provisions of law.
Promptly providing information, reporting on suspicious transactions, and closely coordinating with the law enforcement agencies and other relevant competent authorities in detecting, preventing and combating the crimes in accordance with the law.
Promoting the information, education and communication to raise the customers’ awareness about the use of payment services, intermediary payment services safely to ensure compliance with the law; giving recommendations and warnings so that customers do not engage in prohibited acts, such as: buying, selling, renting, leasing, borrowing, or lending payment accounts, e-wallets; buying, selling, renting, or leasing a bank card or bank card information; opening a bank card in the name of another person; etc.; using or facilitating subjects to use payment accounts, bank cards, e-wallets to conduct money transfers related to gambling, soccer/football betting, or any other illegal purposes.
