On February 08, 2023, the Governor of the State Bank of Vietnam (SBV) issued Decision No. 175/QD-NHNN announcing a number of amendments and supplementations of the administrative procedures related to banks’ establishment and operations, which are performed at the Single Window under the SBV’s jurisdiction.
Specifically, the list of administrative procedures that have been amended and supplemented, which are performed at the SBV (the Banking Supervision Agency), includes:
“The procedures for the approval of a name change of a non-bank credit institution”;
“The procedures for the approval of a head office address change of a non-bank credit institution within the same province or the same centrally-controlled city where the head office of that non-banking credit institution is currently located”;
“The procedures for the approval of a head office address change of a non-bank credit institution (not changing the physical location)”;
“The procedures for requesting an approval of a name change of a microfinance institution”;
“The procedures for requesting an approval of a head office address change of a microfinance institution”.
The list of the administrative procedures which are performed at the SBV provincial and municipal branches includes:
“The procedures for a voluntary termination of a postal transaction office”;
“The procedures for changing a branch office address of a non-bank credit institution, due to the change in the administrative arrangements (not changing the physical location)”;
“The procedures for changing a branch office location of a non-bank credit institution”;
“The procedures for a voluntary termination of the operation, and the dissolution of a branch of a non-bank credit institution”;
“The procedures for changing a branch office location of Co-opBank”;
“The procedures for changing a branch office or a transaction office address of Co-opBank, due to the change in the administrative arrangements (not changing the physical location)”.
The above-mentioned amendments and supplementations of the administrative procedures are related to banks’ establishment and operations, and are implemented in line with Circular No. 27/2022/TT-NHNN dated December 31, 2022 of the SBV Governor amending and supplementing a number of Articles of several Circulars stipulating the decentralization for the handling of administrative procedures in the field of banks’ establishment and operations.
Decision No. 175/QD-NHNN takes effect from March 01, 2023 and shall amend and supplement:
(i) The administrative procedures under the following codes: 1.003292, 1.003288, 1.003266, which were previously announced in Decision No. 248/QD-NHNN dated February 05, 2018;
(ii) The administrative procedures under the following codes: 1.001591, 1.001537, which were previously announced in Decision No. 891/QD-NHNN dated May 07, 2018;
(iii) The administrative procedures under the following codes: 1.001201, which were previously announced in Decision No. 319/QD-NHNN dated March 15, 2016;
(iv) The administrative procedures under the following codes: 1.001655, 1.001668, 1.001650, which were previously announced in Decision No. 234a/QD-NHNN dated February 11, 2019;
(v) The administrative procedures under the following codes: 1.000527, 1.000516, which were previously announced in Decision No. 1139/QD-NHNN dated May 25, 2018.
