On December 11, 2019, the Governor of the State Bank of Vietnam (SBV) issued Decision No. 2562/QD-NHNN announcing the amended, supplemented, or abolished administrative procedures in the field of banking establishment and operations within the scope of the SBV's jurisdiction, which are implemented at the single window unit.
Accordingly, the SBV announced as attachments to this Decision the newly promulgated, amended, supplemented, replaced and abolished administrative procedures, which are provided for at Circular No. 19/2019/TT-NHNN dated November 5, 2019 and Circular No. 21/2019/TT-NHNN dated November 14, 2019 on the operations of the single window unit within the SBV's jurisdiction.
Specifically, the SBV announced 2 amended and supplemented administrative procedures in the field of banking establishment and operations conducted at the Banking Supervision Agency, which are (i) Procedures for requesting the change in the charter capital of the cooperative bank; (ii) Procedures for approving the proposed list of personnel of the cooperative bank.
The SBV publicized 4 amended and supplemented administrative procedures in the field of banking establishment and operations conducted at the SBV provincial branches, which are: (i) Procedures for voluntary termination of operations, dissolution of branches and transaction offices of microfinance institutions; (ii) Procedures for granting license for the establishment of a people's credit fund; (iii) Procedures for requesting an amendment in the charter capital of a people's credit fund; (iv) Procedures for requesting approval of the proposed list of personnel of a people's credit fund.
The SBV announced 1 replacement to administrative procedure in the field of banking establishment and operations conducted at the Banking Supervision Agency, regarding the procedures for opening branches of microfinance institutions that shall be replaced with the two following administrative procedures: (i) Procedures for requesting approval of the establishment of branches and transaction offices of microfinance institutions; (ii) Procedures for requesting approval of establishment of representative offices, non-business units of microfinance institutions.
The SBV announced 3 replacements to the administrative procedures in the field of banking establishment and operations conducted at the SBV provincial branches; specifically: (i) Procedures for extending the operation duration of a branch of a microfinance institution to be replaced by the procedures for announcing the opening of a new branch, a transaction office, a representative office, and a non-business unit of a microfinance institution; (ii) Procedures for changing the location of a branch of a microfinance institution to another province or city; and (iii) Procedures for changing the location of the branch of a microfinance institution in the same province or city shall be replaced by procedures for changing the location of a branch or a transaction office of a microfinance institution.
The SBV abolished 3 administrative procedures in the field of banking establishment and operations, which are: (i) Procedures for opening, changing the name and/or the location, terminating the operations of an office of a microfinance institution within the same province or city; (ii) Procedures for changing a branch name of a microfinance institution; (iii) Procedures for changing the operating area of a people's credit fund due to the division or separation of administrative boundaries after June 1, 2015.
This Decision takes effect on January 1, 2020 and shall abolish the previously-announced administrative procedures coded: 1.00.1660, 1.001644, 1.001579, 1.001559, stipulated in Decision No. 891/QD-NHNN dated May 7, 2018; 2.000055, 1,000149 stipulated in Decision No. 2621/QD-NHNN dated December 12, 2017.
